Definitions:

These are the trading terms and conditions of Preserved Limited.

‘Company’ means Preserved Limited.

Our ‘Website’ means www.preserved.co.nz

 

1.   Privacy Statement

We are committed to protecting your privacy. Authorised employees within the Company may use any information collected from individual customers on a need to know basis.

 

2. Payment

All major Credit/Debit Cards, or Bank Transfer are all acceptable methods of payment. All goods remain the property of the Company until paid for in full.

 

3. E-Purchases

Items purchased through the website are subject to the Consumers’ Rights in accordance with the laws of New Zealand.

 

4. Links from this website

We are not responsible for the content, practices or policies of any external website linked to ours. We encourage you to evaluate the security and trustworthiness of any site connected to this site before disclosing any information to them.

 

5. Copyright Notice

Copyright and other relevant intellectual property rights exists on all text relating to the Company’s services, course content and literature and the full content of this website.

6. Force Majeure

Preserved has no liability for any lack of performance, unavailability or failure of the Services or the Website, or for any failure by us to comply with these terms and conditions where the same arises from any cause reasonably beyond the control of Preserved.

 

7. No Waiver

If Preserved does not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.

 

8. Course Cancellation Policy

8.1 We hold all our events and cookery courses on specific dates. Consequently, the consumer right of cancellation does not apply to orders for these types of Products. You are therefore not entitled to cancel any of our events or cookery courses or to obtain a refund in respect of them, if you no longer are able, or wish to attend them.

 

8.2 If notice of a cancellation is at least 14 days, however, we permit you to transfer your booking to friends and family members or to transfer your booking to another course or event.

 

8.3 Preserved Ltd will always strive to provide workshops on the given day. As circumstances can sometimes be out of our control, however, we reserve the right to cancel the workshops with any length of notice. No refunds will be given but alternative dates will be offered to those affected.  

 

8.4 The Company reserves the right to change the venue of a course when circumstances make it necessary. The customer can expect full notification of this should it occur.

 

8.5 Preserved Ltd is not liable for any travel, accommodation, or any other costs incurred by any persons coming to its workshop.

 

8.6 Customers are advised to take out Travel Insurance that would protect them against loss should unexpected circumstances prevent them from attending a course or event, due, for example, bad weather, illness or bereavement.



9. Gift Certificates

9.1 Gift Certificates are not refundable, and are to be used when obtaining goods or services via the Company website.

 

9.2 Each Gift Certificate has a Reference Code that should be quoted when purchasing online.

 

9.3 Certificates are automatically generated by the computer system and sent via email, and should be printed by the customer. The Customer takes full responsibility for the protection and care of the certificate once it has been sent.

 

9.4 Although most Certificates specify a particular workshop, their value can be used against the purchase of any other service on the Preserved website. No credit balance is given where the item purchased is less than that of the Certificate.

 

9.5 All Gift Certificates have an expiry date. Customers are responsible for viewing on the Preserved website the available courses and using the Certificates to reserve their places on the selected workshops.

 

9.6 When giving the Certificate to someone as a gift, the Customer is responsible for informing the recipient of these conditions.

 

 

10. Private Functions

10.1 ‘Private Function’ is a workshop, meal, celebration or party organised exclusively for a group or family.

 

10.2 The group’s Organiser will negotiate and agree a price, date and any special conditions with Preserved.

 

10.3 A deposit of 20% of the main cost will secure the reservation.

 

10:4 The group may not have exclusive use of the premises unless specifically stated and agreed in writing.

 

10:5 Events are often booked well in advance, and circumstances in the Company can evolve in the intervening period. Should the Company change ownership, the deposit and booking will be transferred to the new owners. The Customer will be immediately informed. If the new Owner declines to accept the arrangement, Preserved will repay the deposit to the Customer.

 

10.6 Cancellation: Private functions often require advance preparation by the Company. The Customer may cancel the booking with at least 21 days notice. Cancellation under 21 days will involve loss of deposit. If the event is rebooked for another date, the deposit can be transferred subject to a reasonable charge to cover losses incurred by the Company.

 

11. General

The laws of New Zealand govern these terms and conditions. By accessing this website and using our services/buying our product you consent to these terms and conditions and to the exclusive jurisdiction of the New Zealand courts in all disputes arising out of such access.

 

12. Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. You are therefore advised to re-read this statement on a regular basis

 

These terms and conditions form part of the Agreement between the customer and us. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
